Sehubungan dengan hal tersebut, Khusus untuk Perseroan yang sudah Go Public, diatur sendiri pengimplementasiannya dalam Surat Badan Pengawas Pasar Modal No. S-1505/PM/1997 Tahun 1997 Tentang Pemberian Jaminan Hutang Kepada Anak Perusahaan (Corporate Guarantee). Dimana dalam peraturan tersebut, dalam rangka perlindungan kepada pemegang saham publik, apabila Perseroan bertindak selaku Corporate Guarantor atas hutang-hutang Anak Perusahaannya, maka hal tersebut hanya dapat dilakukan atas Anak Perusahaan yang sahamnya dimiliki oleh Perseroan yang Go Public tersebut sebesar 99,9% dari seluruh modal saham atas Anak Perusahaan yang telah disetor. Jadi mengenai persyaratan mengenai kepemilikan saham dalam hal ini hanya terdapat dalam pemberian corporate guarantee oleh PT yang bersifat publik.

Selanjutnya, yang perlu diperhatikan adalah terkait siapakah yang menurut anggaran dasar badan hukum tersebut yang berwenang untuk mewakili badan hukum yang bersangkutan dalam memberikan penanggungan korporasi?. Jawabannya adalah jika tidak ada ketentuan khusus tertentu yang mengatur mengenai ini dalam Anggaran Dasar dan dokumen perusahaan lainnya, maka berlakulah prinsip umum, yakni yang berhak mewakili badan hukum adalah mereka yang berwenang mewakilinya dalam tindakan hukum pada umumnya, yang dalam hal ini direksi, baik dengan atau tanpa persetujuan dari organ badan hukum yang lain.
